CUSTOMER SERVICE AGREEMENT
This Agreement is entered into by and between:
Seacoast Priority Services LLC (“Company”), located in Seabrook, NH, and the customer (“Client”) receiving services.
By engaging with Seacoast Priority Services, the Client acknowledges and agrees to the terms below, which apply to all services provided by the Company now and in the future, unless otherwise modified in writing by the Company owner.
1. Payment Terms
- For any services totaling $450 or more, the Client must pay 50% upfront before the service begins, and the remaining 50% is due immediately upon completion of the service.
- Unless otherwise approved by the Company owner, payment may also be arranged on a monthly basis, depending on the nature of the service and scope of the work.
- All invoices must be paid in full by the end of the day on the invoice due date.
- A late fee of $50 per day will be applied to any invoice not paid on time.
- The Client agrees to pay all attorney’s fees, court costs, and collection expenses incurred by the Company in enforcing this Agreement.
2. No Refund Policy
- Seacoast Priority Services maintains a strict no refund policy.
- Under rare and limited circumstances, a service credit may be issued in place of a refund, but only with written approval by the Company owner.
- No monetary refunds will be issued.
3. Chargebacks and Disputes
If a chargeback is initiated for services that have already been rendered, the Client agrees to:
- Pay the full amount of the original invoice, plus
- A $2,500 administrative fee to cover time lost, disruption, and the cost of handling the dispute.
4. Use of Subcontractors
- Seacoast Priority Services reserves the right to use subcontractors to fulfill services at its discretion.
- Clients are not permitted to bypass the Company to engage directly with any subcontractor involved in the project.
- Any communication (verbal, written, electronic, physical gestures, sign language, or otherwise) between the Client and any subcontractor—outside of Seacoast Priority Services’ system—will result in a $5,000 fee per instance.
- All communication and service coordination must go through Seacoast Priority Services.
5. Service Scope and Coverage
- This Agreement applies to all services currently offered by Seacoast Priority Services, as well as any future services added to its offerings.
- Services include (but are not limited to): Lawn Mowing, Yard Cleanups, Hardscapes, Junk Removal, Lawn Installation, Mulch Installation, Gutter Cleanups, Irrigation, Pressure Washing, Fertilization & Weed Control, and any other service added by the Company in the future.
6. Service Delivery & Quality
- Seacoast Priority Services agrees to perform all work in a timely, professional manner.
- Clients who are dissatisfied with the work must notify the Company in writing within 24 hours of service completion. The Company will evaluate the concern and determine if any remedy is warranted (e.g., rework or service credit).
- Services are provided “as-is,” with no warranties beyond industry standards unless explicitly stated in writing.
7. Cancellation & Rescheduling
- If the Client needs to cancel or reschedule a scheduled service, they must provide at least 24 hours’ notice.
- Cancellations or rescheduling requests made less than 24 hours in advance will incur a $150 fee.
- The Company reserves the right to refuse or terminate services at any time if unsafe conditions exist, if the Client engages in inappropriate conduct, or if the Client fails to comply with this Agreement.
8. Property Access & Client Responsibility
- The Client must ensure safe and timely access to the property.
- If the Company cannot perform services due to locked gates, obstructed driveways, hazards, pets, or other conditions, the Client will be charged a $150 trip fee.
- The Company is not responsible for pre-existing damage, normal wear and tear, or damage to items not removed from work areas prior to service.
9. Limitation of Liability
- The Company is not liable for delays or issues caused by weather conditions, access issues, material shortages, third-party actions, or any other factors outside of its control.
- The Company is not responsible for damage to underground utilities, unmarked property features, or items not disclosed by the Client.
- The Client agrees to indemnify and hold harmless Seacoast Priority Services, its team, and its subcontractors against any damages, claims, or liabilities, unless directly caused by the Company’s gross negligence.
10. Photography & Documentation
The Client authorizes Seacoast Priority Services to take photos or videos of the worksite before, during, and after services for documentation, quality control, and marketing purposes. Personal identifying details will not be disclosed.
11. Non-Disparagement
The Client agrees not to make false, misleading, or disparaging statements about the Company. Any breach of this clause will result in liquidated damages of $5,000.
12. Force Majeure
The Company shall not be held liable for delays or failure to perform due to acts of God, severe weather, labor disputes, pandemics, government restrictions, or other circumstances beyond its control.
13. Dispute Resolution – No Lawsuits
- The Client and any vendors agree not to sue Seacoast Priority Services LLC for any reason in any court of law.
- All disputes, claims, or controversies shall be resolved exclusively through binding arbitration in Rockingham County, New Hampshire.
- Each party shall bear its own legal costs, unless otherwise determined by the arbitrator.
14. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of New Hampshire.
15. Entire Agreement & Severability
This Agreement constitutes the entire understanding between the parties. Any amendments must be in writing and signed by the Company. If any provision is deemed unenforceable, the remaining provisions shall remain in full force.
16. Agreement Acknowledgment
By hiring Seacoast Priority Services and submitting payment (in full or partial), the Client acknowledges and accepts all terms stated in this Agreement. This contract applies to all future work unless a new agreement is signed.
